Terms of Service

These terms govern your use of the fitVT app. Please read them together with the Privacy Policy and Legal Notice.

1. Provider and service

fitVT is provided by Nicolas Cukas, Wirbelwies 9, 8200 Schaffhausen, Switzerland. fitVT is a nutrition, training and progress tracking app with AI-assisted features.

The exact feature set may vary by platform, version, country, subscription status and technical availability.

2. Account and minimum age

You must provide accurate information, protect your account and not share credentials. You must be at least 16 years old.

3. Not medical advice

fitVT is not a medical device and does not replace medical, dietary, psychological or sports-medical advice. Calories, macros, TDEE, training guidance, body-fat estimates and AI responses are approximations and may be wrong.

If you have a medical condition, are pregnant, have an eating disorder, feel pain, are injured, have unusual symptoms or are unsure, consult a qualified professional. In emergencies, use local emergency services.

4. AI features

AI features may analyze food photos, text entries and body photos. Results are support tools and must be reviewed by you. You are responsible for not relying blindly on AI outputs for entries, quantities, training choices or health decisions.

5. Subscriptions, purchases and cancellation

Paid features are offered as auto-renewing subscriptions through the App Store or Google Play. Prices, terms, trials and renewal conditions are shown by the relevant store before purchase.

Billing, renewal, cancellation, restore and refunds are generally handled through your store account and the rules of the relevant store. You can manage or cancel a subscription in your store-account settings. Statutory consumer rights remain unaffected.

6. Fair use and prohibited use

AI features, interfaces and content must not be abused, queried automatically, resold, scraped, reverse-engineered or used to infringe third-party rights. Details are set out in the Fair Use Policy.

You must not upload unlawful, third-party, confidential or highly sensitive content unless you are allowed to do so.

7. Availability and changes

We aim to provide a stable app, but we do not promise uninterrupted availability. Maintenance, updates, security measures, store requirements, provider outages or abuse prevention may temporarily limit features.

We may improve, change or discontinue features where there is a valid reason and your legitimate interests are appropriately considered.

8. Rights and your content

Your entered data and uploaded content remain yours. You grant us the rights needed to provide fitVT, run analyses, store data, create backups and provide support/security.

You confirm that you have the necessary rights to uploaded photos and content.

9. Suspension and termination

We may suspend accounts or features where necessary for security, abuse prevention, legal enforcement or compliance with legal obligations. You can delete your account in the app; an active store subscription must also be cancelled in the relevant store.

10. Liability

We remain fully liable for intent, gross negligence, injury to life, body or health, and where mandatory law requires liability. Otherwise, in cases of slight negligence, we are liable only for breach of material contractual duties and limited to foreseeable, contract-typical damage.

To the extent legally permitted, Swiss law applies. Mandatory consumer rights in your country of residence remain unaffected.

11. Changes to these terms

We may update these terms when features, law or operations change. We will inform you about material changes in an appropriate way. Where legally required, we will ask for your consent.
